The starting point under the Family Law Act is that the child should spend equal time with each parent, although in many cases, through the fault of neither party, this is impractical or impossible.
In many cases, the hostility between the parents is such that even the most basic issues, such as who the child lives with and how often they see the other parent, cannot be resolved amicably. In many cases, the overriding consideration in the Family Law Act that the best interests of the child are paramount is ignored by parents using the child to score points off each other.
We can help you resolve these issues and remove much of the unpleasantness. Simply having a third party involved can take some of the bitterness out of the situation. If appropriate, we can help with the preparation of a parenting plan. The court may order that a Family Report be prepared, which will make recommendations as to the arrangements that should be made. We can advise you on whether or not those recommendations are appropriate in all the circumstances.
